Risk Disclosure

This Risk Disclosure ("Disclosure") is part of, and is incorporated by reference into, the VolNinja Terms of Service. By accessing or using the VolNinja software, the Risk Lab, or any other part of the Service (the "Service") provided by OPTIONMIGHTY LTD ("VolNinja"), you acknowledge that you have read, understood, and accepted the risks described below. If you do not understand or accept these risks, do not use the Service.

VolNinja is software. It is not investment advice, it does not trade on your behalf, and it is not a broker-dealer or investment adviser. You trade through your own brokerage account, using rules you configure. All trading risk is yours.

1. Trading involves substantial risk of loss

Trading securities, options, and other financial instruments involves a high degree of risk and is not suitable for every investor. The risk of loss in trading can be substantial. You should carefully consider whether such trading is appropriate for you in light of your financial condition, experience, and risk tolerance. You may lose some or all of your investment, and certain strategies can expose you to losses that exceed your initial investment in a short period of time. Only risk capital — money you can afford to lose — should ever be used for trading.

2. Options carry their own, elevated risks

Options are widely considered a volatile asset class carrying a high degree of financial risk. The value of an option can move rapidly and can expire worthless. Selling (writing) options can create theoretically unlimited or substantial risk. The possibility exists that you could sustain a loss of the entire premium and, for certain positions, materially more.

3. Zero-days-to-expiration (0DTE) and short-dated options are especially risky

VolNinja is designed for short-dated and 0DTE options trading. Short-dated options are acutely sensitive to time decay, gaps, and rapid intraday price moves; they can move from profit to total loss in minutes; liquidity and bid/ask spreads can deteriorate sharply, especially near expiration and during volatile markets; and assignment, pin, and settlement risk can produce outcomes very different from what you expected. These characteristics magnify every other risk described in this Disclosure.

4. Leverage and margin

Options and margin trading involve leverage. Leverage can work for you or against you and can amplify both gains and losses. A relatively small market movement may produce a proportionately much larger impact on your account. You are responsible for meeting any margin requirements imposed by Your Broker, and your broker may liquidate positions to meet them, potentially at a loss.

5. Automation and technology risk

The Service automates actions you configure. Automation does not reduce, and may increase, certain risks. You acknowledge that:

  • Software may contain errors or defects, may not function as you intended, and may not achieve any desired result.
  • User Automations may open, modify, or close positions automatically — or may fail to close positions — at times or in ways you did not intend. You remain responsible for monitoring your account at all times.
  • The Service depends on hardware, operating systems, networks, internet connectivity, the secure tunnel, market-data feeds, and third-party systems, any of which may be delayed, interrupted, congested, or unavailable, rendering the Service or your data inaccessible.
  • Your own configuration, parameters, or human error may cause unintended orders or losses.
  • Backups, upgrades, maintenance, latency, and traffic volume may affect availability and timing.

VolNinja is not responsible for losses, missed trades, or unintended trades arising from any of the foregoing.

6. Brokerage and execution risk

Orders are transmitted to and executed by Your Broker (for example, Interactive Brokers), not by VolNinja. Your broker may reject orders in error or by design, may delay, partially fill, or incorrectly execute orders, and may experience outages. Market data displayed in the Service may be delayed, inaccurate, or incomplete. Execution price, slippage, fills, and timing are determined by your broker and the market, not by VolNinja, and may differ materially from what the Service displays or models.

7. Hypothetical and backtested results — including the Risk Lab

The Risk Lab and any backtests, simulations, projections, probabilities, or hypothetical performance figures are backward-looking or model-based and have inherent limitations.

HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN INHERENT LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING AND DO NOT INVOLVE FINANCIAL RISK. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN. Backtesting is backward-looking and is not indicative of future performance. Among many other factors, simulated results cannot fully account for slippage, fills, liquidity, fees, the impact of financial risk on actual decision-making, or outlier market events that produce wide spreads and uncertain execution. Live results will differ, and may differ materially, from any hypothetical or backtested result. Past results of any trader, system, template, or strategy are not indicative of future returns and should never be the sole basis for a trading decision.

8. No guarantee of profit or return

There is no assurance that you will generate any return, or that any return will be commensurate with the risks taken. VolNinja makes no representation, warranty, or guarantee of any kind regarding profitability, performance, or results.

9. You assume all risk

Any use by you of the Service and of any and all User Automations is strictly at your own risk. You are solely responsible for every order, position, gain, and loss in your brokerage account. You acknowledge that VolNinja does not trade on your behalf, takes no discretion over your account, holds no custody of your funds or securities, and is not a party to any trade.

10. Not investment advice

Nothing in the Service is investment, financial, legal, tax, or accounting advice, a recommendation, or a solicitation. VolNinja is not a broker-dealer, investment adviser, or registered investment adviser. You should consult your own licensed financial, legal, and tax professionals before trading and before relying on any output of the Service.

11. Acknowledgement

By accessing or using the Service, you acknowledge that you have read and understood this Risk Disclosure, that you accept all of the risks described here and any not specifically described, and that you are solely responsible for your trading decisions and results.
